Terms of Service

1. Acceptance of Terms

By accessing or using LatinMixx ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you ("User," "DJ," "you") and LatinMixx LLC.

2. Description of Service

LatinMixx is a promotional DJ collective that provides professional DJs with access to music for performance purposes. Record labels, artists, and their authorized representatives submit promotional tracks to LatinMixx so that subscribed DJs can play them in clubs, at events, on radio, and during livestreams. The Platform offers curated playlists, DJ edits, and organizational tools to support professional DJ workflows.

3. Account Registration

To use LatinMixx, you must:

  1. Be at least 18 years of age.
  2. Provide accurate, current, and complete information during registration.
  3. Maintain the security of your account credentials.
  4. Create only one account per person.

You are responsible for all activity that occurs under your account. If you suspect unauthorized use, you must notify us immediately at support@latinmixx.com.

4. Subscription Plans

LatinMixx offers the following subscription tiers:

  • Basic — Access to standard promotional releases.
  • Pro — Full catalog access including exclusive edits and advance releases.
  • Elite — Priority access, all edits, and priority support.

Billing & Renewal

  • Subscriptions are billed monthly or annually in USD.
  • A 7-day free trial is available for new subscribers.
  • Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
  • Upon cancellation, you retain access until the end of your current billing period. No partial refunds are provided.

5. Promotional Use License

⚠️ This section is critically important. Please read it carefully.

All tracks downloaded from LatinMixx are provided under a promotional use license granted by the rights holder. This license permits:

  • Professional DJ performance in clubs, bars, events, festivals, and private functions.
  • Radio broadcasts and internet radio streams.
  • Livestreamed DJ sets on platforms such as Twitch, YouTube Live, and similar services.

You are strictly prohibited from:

  • Reselling, redistributing, or commercially releasing any downloaded tracks.
  • Sampling or incorporating tracks into new recordings without express written permission from the rights holder.
  • Sharing, uploading, or distributing files via file-sharing platforms, torrent sites, or social media.
  • Uploading tracks to streaming platforms (Spotify, Apple Music, SoundCloud, etc.) in any form.

All tracks remain the exclusive property of the original rights holder (label, artist, publisher, or distributor). LatinMixx does not transfer any ownership rights. Tracks may contain a "Promotional Use Only — Not for Resale" watermark or audio tag.

6. User-Submitted Content

Artists, labels, and their authorized representatives may submit tracks to LatinMixx. By submitting content, you represent and warrant that:

  1. You own or control all rights to the submitted content, or have obtained all necessary permissions.
  2. The content does not infringe on any third-party intellectual property rights.
  3. You grant LatinMixx a limited, non-exclusive license to distribute the submitted tracks to subscribed DJs for promotional performance purposes.

LatinMixx does not claim ownership of any user-submitted tracks.

7. DJ Edits & Remixes

LatinMixx may create promotional edits of submitted tracks, including but not limited to: intro cuts, clean versions (radio edits), extended mixes, outro edits, and DJ-friendly transitions. These edits are derivative works created solely for promotional DJ performance use. The original rights holder retains all ownership, publishing rights, and master rights to both the original recording and any edits created by LatinMixx.

8. Payment Methods

LatinMixx accepts payments via Stripe, PayPal, and Zelle. All prices are listed in USD. Payment processing is handled by secure third-party providers. LatinMixx does not store your full credit card information.

9. Intellectual Property

The LatinMixx name, logo, website design, and proprietary technology are the exclusive property of LatinMixx LLC and are protected by applicable intellectual property laws. User-submitted tracks remain the property of their respective rights holders.

10. DMCA & Copyright

LatinMixx respects the intellectual property rights of all creators. If you believe your copyrighted work has been posted on LatinMixx without authorization, please contact our DMCA agent at dmca@latinmixx.com. For full takedown procedures, see our DMCA Takedown Policy.

11. Limitation of Liability

LatinMixx is a platform that facilitates the distribution of promotional music. We do not create, own, or control the user-submitted content. To the fullest extent permitted by law, LatinMixx shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages for loss of profits, data, or goodwill.

12. Indemnification

You agree to indemnify, defend, and hold harmless LatinMixx LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform or your violation of these Terms.

13. Termination

LatinMixx reserves the right to suspend or terminate your account at its sole discretion, with or without notice, for any violation of these Terms or for any other reason deemed necessary. Upon termination, your right to access and use the Platform and any downloaded content ceases immediately.

14. Changes to Terms

LatinMixx may update these Terms from time to time. We will notify users of material changes via email or through a notice on the Platform. Your continued use of LatinMixx after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New York.
